1. The cost of scar repair after a traffic accident shall be borne by the accident party and the compulsory insurance company. The injured party may, according to the accident confirmation, take the accident party and the compulsory insurance company as * * * and together with the defendant, request the court for personal injury compensation according to law.

2. Legal basis: Article 76 of the Road Traffic Safety Law of the People's Republic of China

If a traffic accident of a motor vehicle causes personal injury or property loss, the insurance company shall make compensation within the liability limit of compulsory motor vehicle third-party liability insurance; The insufficient part shall be liable for compensation in accordance with the following provisions:

(1) In case of a traffic accident between motor vehicles, the party at fault shall be liable for compensation; If both parties are at fault, they shall share the responsibility according to their respective fault proportions.

(two) motor vehicles and non-motor vehicle drivers and pedestrians have traffic accidents, and the non-motor vehicle drivers and pedestrians are not at fault, and the motor vehicle party shall be liable for compensation; If there is evidence that non-motor vehicle drivers and pedestrians are at fault, the liability for compensation of the motor vehicle party shall be appropriately reduced according to the degree of fault; If the motor vehicle party is not at fault, it shall be liable for compensation not exceeding 10%.

The loss of traffic accidents is caused by non-motor vehicle drivers and pedestrians deliberately colliding with motor vehicles, and the motor vehicle party is not liable for compensation.

Second, what is the claim after the traffic accident?

1, report the case in time. After a traffic accident, the driver immediately reports to the traffic accident handling organ and promptly reports the case to the insurance company that underwrites the vehicle;

2. Investigate and determine the damage. After receiving the report, the insurance company quickly dispatched a claim adjuster to investigate the accident. Verify the loss amount of damaged vehicles and property as required;

3. Rescue treatment. If someone is injured, you should call the emergency number quickly and send it to the hospital for rescue;

4. Solve the case through mediation. After the amount of property loss is determined, after the injured person is cured and discharged from the hospital, or after the traffic police department investigates the relevant situation of the accident dead person, the traffic police department mediates the two sides of the accident according to laws and regulations, and the responsible party closes the case after fulfilling the obligation of compensation respectively;

5. Submit a claim. After the mediation, the insured shall submit the accident claim materials to the insurance company in time;

6. Claim payment. After the insurance company calculates the indemnity amount according to the insurance clauses and laws and regulations, it notifies the insured to receive the indemnity and then closes the case.
