In China, the standard of nose disability appraisal is determined according to the relevant provisions in the Interim Provisions on the Administration of Labor Ability Appraisal in People's Republic of China (PRC). This regulation defines the scope, basis and procedure of the evaluation object. Common types of nasal disability include the following: nasal bone fracture, nasal process deformation, nasal septum deviation, nasal cavity injury and so on. Identification criteria usually include the degree of nasal deformation and the degree of nasal respiratory function damage. For different types of nasal disabilities, the identification criteria may be different. The identification of nasal injury requires professional medical knowledge and skills, and cannot be carried out at will. In identification, accurate identification results are usually obtained through physical examination, medical imaging and other means. The appraisal results will serve as a reference for labor ability appraisal and damage compensation.
How to calculate the amount of compensation for nose disability? The amount of compensation is usually determined according to the degree of nasal disability and other related factors. In China, the compensation standard for nasal disability is determined by the local people's government according to the local actual situation and market price with reference to the relevant contents in the Regulations on Work-related Injury Insurance concerning the provision of pensions for workers' behavioral ability damage. At the same time, the employer shall bear the corresponding liability for compensation in accordance with the requirements of the Labor Contract Law, the Regulations on Industrial Injury Insurance and other laws and regulations.
In order to accurately evaluate the influence of nose injury on labor ability, the identification standard of nose injury is formulated. When conducting identification, we should strictly abide by the requirements of laws and regulations and the standards of medical knowledge. For the economic losses caused by nose disability, the employer shall bear the corresponding liability for compensation in accordance with the requirements of relevant laws and regulations.
