After the basic medical insurance fund pays in advance, it has the right to recover from the third party; After deducting the expenses borne by the third party, pay the difference medical expenses. The insured person shall provide the information required for sporadic reimbursement to the social security agency of the insured place to apply. If the required original materials have been collected by a third party, the insured shall provide a copy of the certification materials and materials collected by the third party;
4. I am fully responsible for the traffic accident, and the medical expenses caused by my fault are not included in the payment scope of the basic medical insurance fund, and the medical insurance department must reimburse it.
Legal basis: Article 30 of the Social Insurance Law of People's Republic of China (PRC).
The following medical expenses are not included in the payment scope of the basic medical insurance fund:
(a) shall be paid by the industrial injury insurance fund;
(2) It shall be borne by a third party;
(three) shall be borne by public health;
(4) Go abroad for medical treatment.
