(1) The factory director is the legal representative of the enterprise. The enterprise establishes a production management system headed by the factory director. The factory director is in a central position in the enterprise and is fully responsible for the material and spiritual civilization construction of the enterprise.
(2) Unless otherwise stipulated in the State Council, the factory director shall be selected in one of the following ways according to the situation of the enterprise: first, appointed or recruited by the competent government department; Second, it is elected by the enterprise workers' congress. Directors appointed or hired by the competent government departments shall solicit the opinions of the representatives of the employees; The factory director elected by the enterprise workers' congress shall be reported to the competent government department for approval.
(3) The factory director shall exercise the following functions and powers in the production, operation and management of the enterprise: (1) To decide or submit the plans of the enterprise for examination and approval in accordance with the laws and regulations of the State Council. (2) Deciding on the establishment of the enterprise management organization. (three) to submit to the competent department of the government for appointment or removal of deputy factory-level administrative leading cadres. (four) the appointment and removal of middle-level administrative leading cadres in enterprises. (five) put forward the salary adjustment plan, bonus distribution plan and important rules and regulations, and submit them to the workers' congress for examination and approval. Put forward suggestions on the use of welfare funds and other major issues related to employee welfare, and submit them to the employee congress for deliberation and decision. ⑥ Reward and punish employees according to law; Draw the competent government departments to reward and punish the deputy factory-level administrative leading cadres.
(4) The factory director must rely on the employees to fulfill the enterprise obligations stipulated in the Enterprise Law, support the work of the workers' congress, trade unions and other personnel, and implement the decisions made by the workers' congress according to law.
