Legal analysis: The member countries of the Nice Alliance adopt the International Classification of Goods and Services for Trademark Registration (Nice Classification). The current Nice classification divides goods and services into 45 categories, of which goods are 1 ~ 34 categories and services are 35 ~ 45 categories. Trademark registration categories include: chemical raw materials; Pigment coating; Daily chemical products; Fuel grease; Medicine; Metal materials; Mechanical equipment; Hand tools; Scientific instruments; Medical devices; Lighting and air conditioning; Means of transport; Firearms and fireworks; Jewelry clocks and watches; Musical instrument; Office supplies; Rubber products; Leather leather goods; Building materials; Furniture; Kitchen sanitary ware; Rope net with awning; Yarn; Cloth; Clothing, shoes and hats; Button zipper; Carpet mat; Fitness equipment; Food; Convenience food; Feed seeds; Beer drinks; Wine; Tobacco smoking set; Advertising sales; Financial property management; Building repair; Communication services; Transportation and storage; Material processing; Education and entertainment; Website service; Catering and accommodation; Medical horticulture; Social services.
Legal basis: Article 4 of the Trademark Law of People's Republic of China (PRC), if a natural person, legal person or other organization needs to obtain the exclusive right to use a trademark for its goods or services in production and business activities, it shall apply to the Trademark Office for trademark registration. The application for registration of a malicious trademark that is not intended to be used shall be rejected. The provisions of this Law on commodity trademarks shall apply to service trademarks.
