Article 2 Any enterprise engaged in the production and operation of yellow platinum and jewelry and jade ornaments within the territory of this province may refer to these measures.
Article 3 The principle that whoever sells is responsible for after-sales service shall be implemented in these Measures. Contracts between sellers and producers, sellers and suppliers, and sellers and repairers shall not exempt the basic responsibilities and obligations of "after-sales service" in these Measures.
Article 4 These Measures are the basic requirements for developing after-sales service (hereinafter referred to as "basic after-sales service"). Sellers and producers who fail to fulfill the promise of "basic after-sales service" shall bear corresponding legal responsibilities. These measures encourage producers and sellers to make "after-sales service" commitments that are more beneficial to consumers.
Article 5 The content of "basic after-sales service" is "three guarantees". Namely: guaranteed repair, replacement and return.
Article 6 "Three Guarantees" shall be calculated within a time limit from the date of invoice. During the "Three Guarantees" period, consumers can enjoy the "Three Guarantees" after-sales service with invoices and "Three Guarantees" vouchers, except that the products cannot be used normally or their appearance is seriously affected due to improper use and storage by consumers.
Article 7 Yellow platinum ornaments refer to ornaments with gold and platinum as the main components. Jewelry and jade ornaments are the general names of natural jewelry and jade (including natural gemstones, natural jade and natural organic gemstones) and artificial products (including synthetic gemstones, artificial gem, divided gemstones and recycled gemstones).
The bracket inlaid with jewels and jade ornaments is made of precious metals such as yellow platinum (precious metals include gold, silver, platinum, palladium, iridium, ruthenium, rhodium and osmium); Brackets are decorations made of other materials, and the replacement and repair of brackets have not been included in these measures yet;
Non-inlaid jewelry and jade ornaments, including all kinds of jade pendants and pearls (cultured). (uncut jewelry, jade and materials) are not included in these measures.
Article 8 If the following quality problems occur within 0/5 days from the date of sale, consumers can choose to repair, replace or return them. When returning the goods, the seller shall refund the payment in one lump sum according to the invoice price:
(a) Yellow and platinum jewelry with insufficient color or quality;
(two) the appearance of yellow and platinum jewelry has obvious sand holes, dark seams or fractures;
(3) The inlaid claw of inlaid jewelry is rough or has a slanting head phenomenon, which is easy to be pulled by the hook, causing the inlaid diamond or gem to loosen;
(4) Uneven inlay pitch, and diamonds and precious stones are skewed between teeth;
(five) due to structural defects affecting the normal use;
(six) the surface of yellow and platinum jewelry is short of plating, hanging stains, file marks, hammer marks and other conditions that affect the appearance:
(seven) bracelet assembly failure, unstable structure, affecting the use of;
(eight) the commodity logo or certificate is inconsistent with the jewelry sold;
(nine) the goods identified as unqualified by the legally authorized department;
(ten) other circumstances stipulated by laws, regulations and rules that should be returned for consumers.
Article 9 If the quality problems listed in Article 8 of these Measures occur within/0/5 days from the date of sale, consumers may choose to repair or replace them. In principle, the replacement weight shall not be lower than that of the original goods. If the replacement weight exceeds the weight of the original goods, the weight and color of the excess part shall be priced according to the quotation on the day of replacement.
Yellow platinum jewelry is guaranteed for one year with the sales invoice from the date of sale, and the color, weight and name of the repaired jewelry must be consistent with the invoice.
Tenth from the date of sale 15 to 30 days, the quality problems listed in Article 8 of these measures, consumers can choose to repair or replace. In principle, the replacement weight shall not be lower than that of the original goods. If the replacement weight exceeds the weight of the original goods, the weight and color of the excess part shall be priced according to the quotation on the day of replacement. If the consumer chooses to repair, the seller shall repair the jewelry within 30 working days, and shall not charge any fees to the consumer.
Article 11 It is fraudulent for consumers to buy jewelry with insufficient color, diamonds and precious stones that do not conform to the inspection grade, or to pass off the fake as the real (including passing off synthetic or processed precious stones as natural precious stones) after inspection. Within two years from the date of issuance of the appraisal report, consumers can apply to the relevant administrative departments or consumer associations for handling in accordance with the provisions of Article 49 of the Consumer Law with invoices and appraisal reports.
Article 12 The validity period of the replaced "Three Guarantees" shall be recalculated from the date of replacement, and the seller shall affix the replacement stamp on the back of the invoice.
Article 13 Within the validity period of the "Three Guarantees", if it cannot be used normally after being repaired twice due to quality problems, the seller shall be responsible for replacing the products of the same model and color for consumers free of charge with the repair records and vouchers provided by the repairer, and the excess part shall be handled in accordance with the provisions of Articles 9 and 10 of these Measures. Or return the goods in accordance with the provisions of Article 14 of these Measures.
Article 14 Within the validity period of the "Three Guarantees", if the seller meets the exchange conditions and the consumer is unwilling to exchange the goods because the seller does not have the same type of jewelry, the seller shall return the goods; If there is a product of the same type, and the consumer is unwilling to exchange it and asks for a return, the seller shall return it. The depreciation fee for the return of yellow platinum jewelry is 0.5 ‰ per day; A depreciation charge of 0.2% is charged for jewelry return every day. The depreciation expense shall be calculated from the date of invoice issuance to the date of return, in which the repair occupation and the time to be repaired shall be deducted.
Fifteenth on the last day of the validity of the "three guarantees", if there are legal holidays, it will be postponed according to the number of legal holidays.
Sixteenth in the period of validity of the "three guarantees" in any of the following circumstances, the "three guarantees" will not be implemented, but the repair can be charged:
(a) there is no valid certificate or the valid certificate is inconsistent with the contents of the repaired jewelry;
(two) the damage caused by the demolition of the "three guarantees" operators;
(three) damage caused by improper use and improper storage;
(4) Damage caused by force majeure.
Seventeenth producers, sellers, repairers, due to bankruptcy, closure, merger, division, their "three guarantees" responsibility in accordance with relevant state laws and regulations.
Article 18 Henan Jewelry and Jade Quality Testing Station (formerly Jewelry and Jade Testing Center of Zhengzhou Institute of Mineral Comprehensive Utilization, Chinese Academy of Geological Sciences) is entrusted by Henan Consumers Association and Henan Jewelry and Jade Association as the quality dispute detection unit for the implementation of these Measures.
If consumers and business operators need to conduct testing and appraisal due to disputes over jewelry quality, the appraisal fee shall be paid in advance by the proposer and borne by the responsible party.
Article 19 When a consumer has a dispute with a seller, repairer or producer due to the "three guarantees" of a product, he may apply to the Provincial Consumers Association and the Provincial Gemstone Association for mediation, or apply to the Arbitration Commission for arbitration, or bring a lawsuit directly to the people's court.
Twentieth these measures are inconsistent with the relevant laws and regulations of the state, according to the relevant provisions of the state.
Article 21 These Measures were drafted and promulgated by Henan Consumers Association and Henan Gemstone Association.
