The term "full-time escort personnel" as mentioned in the Regulations refers to the full-time escort personnel of military industry, finance, important state warehouses, large-scale water conservancy, electric power, communication projects and confidential transportation systems equipped with official guns according to law, and the full-time escort personnel of security service companies engaged in armed escort with the approval of the public security organs of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
The regulations clearly stipulate the conditions of full-time escort personnel, the examination procedures and the circumstances under which guns can be carried and used.
According to the regulations, full-time escort personnel should immediately stop using guns when the relevant actors stop committing violent crimes or lose their ability to continue committing violent crimes.
Full-time escort personnel change guns or gun parts without authorization; In violation of regulations, the regulations stipulate penalties for carrying and using guns or giving guns to others for use, and guns are out of control.
According to the regulations, full-time guards and escorts who do not meet the statutory requirements are reported to the public security organs for examination and approval, or if they do not have a gun certificate, they are allowed to carry and use guns; Failing to establish or effectively implement the gun and ammunition management system, resulting in the theft, robbery or loss of guns and ammunition; Failing to inspect guns in accordance with regulations; If the scrapped guns are not turned over, the directly responsible person in charge and other directly responsible personnel of the relevant units shall bear corresponding responsibilities. If the circumstances are serious, criminal responsibility will be investigated.
The regulations stipulate that if full-time guards and escorts use guns in accordance with regulations, causing innocent casualties or property losses, their units shall compensate the victims according to law.
The regulations also stipulate the inspection and supervision duties that public security organs should perform.
Regulations on the administration of the use of guns by full-time guards and escorts
Article 1 In order to strengthen the management of guns used for guarding and escorting official duties and ensure that full-time guarding and escorting personnel use guns correctly, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Control of Firearms (hereinafter referred to as the Law on the Control of Firearms) and with reference to the Regulations of the People's Police of the People's Republic of China on the Use of Police Equipment and Weapons.
Article 2 The term "full-time guards and escorts" as mentioned in these Regulations refers to the full-time guards and escorts of military industry, finance, important state warehouses, large-scale water conservancy, electric power, communication engineering and confidential transportation systems, and the full-time guards and escorts of security service companies approved by the public security organs of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government to engage in armed guards and escorts.
Article 3 Full-time guards and escorts equipped with official guns must meet the following conditions:
(a) citizens of China who have reached the age of 20, are physically and mentally healthy and have good conduct;
(2) Having no history of mental illness and other diseases that can't control the capacity for behavior;
(3) No record of administrative detention, education, compulsory detoxification, reeducation through labor, reeducation through labor and criminal punishment;
(4) Having received professional training and being familiar with the provisions of laws, regulations and rules governing the use of firearms;
(five) master the skills of gun use and maintenance.
Full-time guards and escorts equipped with official guns must be strictly in accordance with the conditions stipulated in the preceding paragraph and reported to the public security organs of the municipal people's governments with districts where they are located after being assessed by their units; Those who pass the examination shall be reported to the public security organs of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government for examination and approval in accordance with the provisions of the gun control law, and the public security organs of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall issue them with gun certificates.
Article 4 Full-time guards and escorts can only carry and use guns in accordance with the provisions of these Regulations when performing guard and escort tasks.
The behavior of full-time guards and escorts carrying and using guns according to law is protected by law; Those who illegally carry or use guns shall bear legal responsibilities according to law.
Article 5 Full-time guards and escorts may not use guns if they are able to protect the security of the guard target and the articles under escort in other ways when performing guard and escort tasks; If it is really necessary to use guns, the purpose should be to protect the guarded targets and articles from infringement, and try to avoid or reduce casualties and property losses.
Article 6 Full-time guards and escorts may use guns when performing guard and escort tasks, in case of the following emergencies, which are not enough to stop violent crimes without using guns:
(1) Security targets and articles under escort are subjected to violent attacks or are in imminent danger of being subjected to violent attacks;
(2) Full-time guards and escorts are attacked by violence, endangering their lives, or guns and ammunition are robbed or robbed.
Article 7 Full-time guards and escorts shall not use guns in places where a large number of inflammable, explosive, toxic and radioactive dangerous goods are stored. However, unless guns are used to stop crimes, it will directly lead to serious harmful consequences.
Article 8 Full-time guards and escorts shall immediately stop using guns under any of the following circumstances:
(1) The perpetrator stops committing violent crimes;
(2) The relevant actor loses the ability to continue to commit violent crimes.
Article 9 After using guns, full-time escort personnel shall immediately report to their unit and the public security organ where the case occurred. After receiving the report, the unit where the case occurred and the public security organ shall immediately send people to the scene.
After receiving the report on the use of guns by full-time guards and escorts, the unit to which the full-time guards and escorts belong shall immediately report to the local public security organ and submit a written report on the use of guns to the local public security organ afterwards.
Article 10 Units that are equipped with guns for guards and escorts for official duties according to law shall establish and improve the responsibility system for the management of gunmen, the system for the storage and collection of guns and ammunition, and the responsibility system for gun safety; Strengthen legal and safety education for gun holders approved in accordance with the provisions of Article 3 of these regulations, organize regular training, and regularly check the storage and use of guns.
Article 11 Units equipped with guns for guards and escorts in official duties according to law shall set up special gun storage rooms or use special safes to keep guns and ammunition in a centralized and unified way. Guns and ammunition must be stored separately, with double locks and 24-hour duty. The doors and windows of the warehouse (room) where guns and ammunition are stored must be firm and equipped with anti-theft alarm facilities.
Article 12 Full-time guards and escorts must take good care of guns and ammunition to prevent them from being lost, stolen, robbed or other accidents. Guns and ammunition must be returned immediately after the task is completed.
It is strictly forbidden to carry guns and ammunition when not performing security or escort tasks, and it is strictly forbidden to carry guns and ammunition after drinking or drinking.
Article 13 The public security organ shall regularly inspect and supervise the establishment and implementation of the gun control system by units that are equipped with guards and escort official guns according to law within its jurisdiction.
Fourteenth full-time guards and escorts in any of the following circumstances, the unit should stop armed guards and escorts, take back the gun certificates, and timely hand over the gun certificates to the public security organs:
(a) transferred from full-time guard and escort jobs;
(two) the theory and live ammunition examination failed;
(3) Being placed on file for investigation due to criminal cases or other cases of violation of law and discipline;
(4) changing guns or gun parts without authorization;
(5) Carrying or using guns in violation of regulations or handing them over to others for use, and the guns are out of control;
(6) losing guns or being responsible for stealing or robbing guns.
Full-time guards and escorts who commit the acts mentioned in Items (4), (5) and (6) of the preceding paragraph, causing serious consequences, shall be investigated for criminal responsibility in accordance with the provisions of the Criminal Law on the crimes of illegal possession of guns and ammunition, illegal carrying of guns and ammunition, illegal renting and lending of guns or failure to report the loss of guns; If it is not serious enough for criminal punishment, it shall be given administrative punishment in accordance with the provisions of the Gun Control Law.
Article 15 If a unit equipped with guards and guns for escorting official duties in accordance with the law violates the regulations on gun control and has any of the following circumstances, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions of gross demerit, demotion or dismissal or corresponding disciplinary sanctions according to the law; If serious consequences are caused, criminal responsibility shall be investigated in accordance with the provisions of the Criminal Law on the crime of dereliction of duty, abuse of power, failure to report lost guns or other crimes:
(1) Failing to establish or effectively implement the management responsibility system for gunmen;
(2) reporting full-time guards and escorts who do not meet the statutory requirements to the public security organs for examination and approval, or allowing those without gun certificates to carry and use guns;
(3) Failing to report to the public security organ after using guns;
(4) Failing to establish or effectively implement the firearms and ammunition management system, resulting in the theft, looting or loss of firearms and ammunition;
(5) Failing to report guns and ammunition stolen, robbed or lost to the public security organ in time;
(6) Failing to inspect guns in accordance with regulations;
(7) Failing to turn over scrapped guns;
(eight) other illegal cases involving guns.
Article 16 Where full-time guards and escorts use guns in accordance with the provisions of these Regulations, causing innocent casualties or property losses, their units shall compensate the victims for their losses according to law.
Full-time guards and escorts who use guns in violation of the provisions of these regulations, causing casualties or property losses, shall be liable for compensation in addition to criminal or administrative punishment according to law.
Seventeenth public security organs have one of the following acts, resulting in serious consequences, the directly responsible person in charge and other directly responsible personnel in accordance with the provisions of the Criminal Law on the crime of abuse of power and dereliction of duty, shall be investigated for criminal responsibility according to law; If it is not serious enough for criminal punishment, administrative sanctions such as gross demerit, demotion or dismissal shall be given according to law:
(1) approving the relevant units to be equipped with guns for guarding and escorting official duties beyond the statutory scope;
(2) Issuing certificates for holding guns for guarding and escorting official duties to persons who do not meet the statutory requirements;
(three) do not perform the duties of supervision and management as stipulated in these regulations, resulting in consequences.
Article 18 These Regulations shall come into force as of the date of promulgation.

Four, the transport of dangerous goods, the escort must be in conjunction with the driver, the shipper should be on-site inventory. Master the nature, hazard characteristics and use characteristics of packaging containers of escorted dangerous goods.
Five, the escort personnel must supervise and inspect the types of goods assembly, and it is forbidden to mix blasting equipment that conflicts with the nature of transportation.
Six, the escort personnel must supervise the loading of explosives on the spot, according to the requirements of loading and unloading, people who do not understand safety knowledge, are not allowed to load and unload blasting equipment.
Seven, in the process of transportation, the escort to urge the driver to speed limit, keep the distance. During stopover, stay away from building facilities and crowded places, and be supervised by special personnel to ensure the safe arrival of dangerous chemicals during transportation.
Eight, if you need to eat on the way because of the long transportation distance, it is strictly forbidden to drink alcohol.
Nine, due to the dereliction of duty of the supercargo, resulting in the theft, loss or damage of dangerous goods, the supercargo shall take full responsibility. Causing serious consequences, handed over to the public security department.
Ten, the transport of explosives should be based on two certificates (purchase certificate, transport certificate) for transportation. Eleven; In the process of transporting and escorting dangerous chemicals, if there is a traffic accident or theft, loss or leakage, it should be reported to the relevant leaders of the unit in time, and at the same time to the local departments responsible for the safety supervision of dangerous chemicals and the public security, environmental protection and quality inspection departments, and all possible early warning measures should be taken. Resolutely stop drivers from driving into areas where dangerous chemicals vehicles are prohibited.
Seven points for attention in applying for escort service:
1. The articles under armed escort must be legal cash, important cultural relics, artworks, securities, gold and silver jewelry, guns, etc.
Two, the escort business of each enterprise or individual, the upper limit of the insured price does not exceed100000 yuan.
