Chapter I General Provisions

Article 1 In order to further standardize the jewelry and jade jewelry market, improve the competitiveness of enterprises, guide enterprises to strive for famous brands, urge enterprises to improve product quality, and standardize the behavior of jewelry and jade jewelry practitioners in China. Under the guidance of the Ministry of Land and Resources and relevant state ministries and commissions, this Convention is formulated in accordance with relevant state laws and regulations and the actual situation of this industry.

Article 2 The jewellery and jade jewelry industry mentioned in this Convention refers to the general name of enterprises and institutions engaged in the design, processing, wholesale, retail, equipment manufacturing, jewellery packaging, scientific research, education, testing and appraisal related to jewellery and jade jewelry.

Article 3 The basic principles of the self-discipline convention for the jewelry industry are patriotism, law-abiding, fairness and good faith.

Article 4 All members of China Gemstone Association are deemed to have joined this Convention automatically. It is suggested that employees in the whole industry should consciously join this convention and actively publicize and create a good environment for the industry from the perspective of safeguarding the interests of the country and the whole industry.

Article 5 China Gemstone Association is the executive body of this Convention and is responsible for organizing the implementation of this Convention.

Chapter II Self-discipline Clause

Sixth consciously abide by the relevant laws, regulations and policies on the development and management of the jewelry industry, and actively promote the construction of professional ethics in the industry.

Article 7 Encourage and support fair, just, lawful and orderly industrial competition, and oppose unfair means of industrial competition.

Eighth consciously safeguard the legitimate rights and interests of consumers, and shall not infringe upon the legitimate rights and interests of consumers in any way or means.

Article 9 Employees in the jewelry and jade jewelry industry shall consciously abide by the provisions of the jewelry and jade jewelry industry formulated by the state, and consciously fulfill the self-discipline obligations of the jewelry and jade jewelry industry:

(1) Consciously maintain the market order of this industry, and strictly abide by the Product Quality Law of People's Republic of China (PRC), Price Law of People's Republic of China (PRC), Anti-unfair Competition Law of People's Republic of China (PRC), Metrology Law of People's Republic of China (PRC) and Consumers of China.

(2) No false discount, low-price dumping or vicious price competition shall be allowed, and the regulations prohibiting price fraud promulgated by the State Planning Commission shall be strictly observed.

(3) Don't do anything detrimental to the image of the industry anywhere in any way, and support and cooperate with relevant activities of local trade associations.

(4) In the course of operation, enterprises earnestly fulfill their commitments to consumers.

(5) Production enterprises should strengthen management and attach importance to the quality of all aspects of processing and production. Ensure that the quality of goods is consistent with the appraisal certificate. All unqualified products and products whose quality is inconsistent with the appraisal certificate are guaranteed not to leave the factory (self-sold products).

(six) when purchasing goods, distribution enterprises should strictly control the quality of goods and the quality of commodity appraisal certificates, and put an end to the circulation and sale of goods whose quality is inconsistent with the certificates.

(7) distribution processing enterprises consciously resist false certificates in the inspection and appraisal work, and actively report and expose the producers of false certificates. If false certificates are found in the market inspection, the distribution and processing enterprises shall bear corresponding responsibilities.

(8) Testing and authentication institutions should strengthen business and technical management, improve the quality and sense of responsibility of staff, establish a self-restraint mechanism, and improve the scientific and fair work.

(9) Testing and appraisal institutions should do a good job in testing and appraisal according to the standards promulgated by the state, and consciously resist the unreasonable demands of some distribution and processing enterprises; Do not attract customers by improving the quality level of product certification; When signing the cooperation agreement on testing and appraisal with the distribution and processing enterprises, there shall be no clauses that affect the independence and impartiality of the testing and appraisal institutions, and there shall be no improper requirements for the quality level of testing and appraisal. If it is found that there is an error in the appraisal certificate issued by the testing and appraisal institution, the testing and appraisal institution shall bear the corresponding responsibility.

Article 10 Strengthen exchanges and cooperation, study and discuss the development strategy of China's jewelry industry, and put forward policy and legislative suggestions for the construction, development and management of China's jewelry industry.

Eleventh support and adopt various effective ways to cooperate in the design, production, scientific research and other fields of jewelry and jade jewelry industry, encourage the development of jewelry and jade jewelry styles with China national characteristics, and create a good environment for the development of the industry.

Article 12 Actively participate in international cooperation and exchanges.

Thirteenth consciously accept the supervision and criticism of the industry from all walks of life, resist and correct unhealthy trends in the industry.

Chapter III Implementation of the Convention

Article 14 China Gemstone Association timely reflects the wishes and requirements of enterprises and institutions in the industry to relevant government departments, safeguards the legitimate interests of enterprises and institutions in the industry, organizes the implementation of the Convention on Self-discipline of Jewelry and Jade Jewelry Industry, and supervises and inspects the compliance of enterprises and institutions in the industry with this Convention.

Fifteenth relevant enterprises and institutions in the industry in violation of the Convention, any other units have the right to report to the Convention enforcement agencies in a timely manner, requiring the Convention enforcement agencies to mediate, safeguard industry unity and safeguard the overall interests of the industry.

Article 16 If the violation of the Convention by enterprises and institutions in the industry has caused adverse effects, serious effects or extremely bad effects, which are verified by verification, the Convention enforcement agencies shall give internal criticism, informed criticism and media exposure according to different situations, or hand them over to the relevant state law enforcement departments for handling.

Article 17 Enterprises and institutions in the industry that have implemented this Convention in an exemplary manner or found no problems in supervision and inspection shall be commended, circulated and commended, and given priority to be recommended as "famous brands in China's jewelry industry", "assured demonstration stores" and "excellent quality inspection institutions". And recommended to the relevant state administrative departments as inspection-free products.

Article 18 China Gemstone Association accepts complaints about violation of the Convention in the industry and complaints from consumers, and sets up a special complaint telephone number.

Article 19 The final interpretation right of this Convention belongs to China Gemstone Association.

Article 20 This Convention was discussed and adopted by the National Jewelry Industry Self-discipline Conference and came into force on April 6, 2003.
