(1) Appraisal of the value of the articles involved entrusted by the judicial organs at the same level;
(2) Appraisal of the value of the articles involved entrusted by other judicial organs. All county-level cities and districts shall be responsible for the appraisal of the value of the articles involved, and shall be entrusted by judicial organs other than those specified in the preceding paragraph. Sixth city price management department is responsible for organizing the training of full-time value appraisers involved in the case. Those who pass the training and examination will be issued with work permits for the value appraisal of the articles involved, and the certificates will be used for the value appraisal of the articles involved. Article 7 Where a unit entrusts a value appraisal institution involved in the case to conduct value appraisal, it shall issue a power of attorney. The power of attorney shall specify the name, specification, quantity, source, purchase time and other relevant information and materials of the goods. Article 8 Full-time personnel involved in the appraisal of the value of articles involved in the case shall be avoided in any of the following circumstances:
(1) Being a party to the case or a close relative of a party or agent ad litem;
(2) Having an interest in the handling of this case;
(3) Other circumstances stipulated by laws and regulations. Article 9 The following valuation principles shall be followed in determining the value of the articles involved:
(a) belongs to state price, according to the provisions of the state;
(2) If it belongs to the national guidance price, it shall be determined according to the price range and batch stipulated by the state and the market price level of local similar commodities;
(three) belongs to the market adjustment price, according to the batch and the local market similar, with the quality of goods compared to the medium price level. Article 10 The determination of the value of the articles involved shall be based on the time required by the entrusting unit and calculated in RMB according to the following valuation methods:
(1) The commodities in circulation are priced according to the sales price of local commercial units;
(two) products produced in other places, the finished products are priced according to the sales price of local commercial units; Semi-finished products can be converted according to the actual stage in the production process and the price of finished products;
(three) agricultural and sideline products are priced according to the sales price of local commercial units and farmers' markets;
(4) Handicrafts made of gold, silver and jewelry shall be priced according to the sales price of local franchisees;
(five) non collection of cultural relics, antiques, calligraphy and painting, with the sales price of local franchise units;
(six) waste products and inferior commodities are priced according to the purchase price of local major material recycling units;
(seven) obsolete, damaged or used items, should be combined with the price and obsolescence of similar local items at the time of the incident in accordance with the relevant provisions;
(8) Goods sold or paid off may be priced at realizable prices in accordance with the principle of realizing value as soon as possible;
(9) If the articles involved have been lost or really cannot be provided, the valuation shall be made in accordance with the relevant provisions when determining the value. Article 11 After the appraisal of the value of the articles involved, the appraisal institution shall issue the Appraisal of the Value of the Articles involved, and affix the seal of the appraisal institution and the special seal for the appraisal of the articles involved. Article 12 If the entrusting unit has any objection to the Certificate of Value of Articles Involved issued by the value appraisal institution involved in the case, it may entrust the value appraisal institution involved in the case established by the superior price department of the value appraisal institution for review. Thirteenth items involved in the value of the charges according to national and provincial regulations. Fourteenth administrative law enforcement agencies entrusted to the confiscation, confiscation and seizure of the goods involved in the value appraisal, can be implemented with reference to these measures.
