1. If you give valuables, such as gold and silver jewelry, real estate, cars, etc., it depends on whether the purpose is to get married.
(1) If it is not for the purpose of marriage, it is a voluntary gift during love, so you can't claim to return it.
(2) During the period of love, both parties create conditions for marriage. The gift of property arising from the engagement contract is different from the general gift and belongs to conditional gift. If the conditions of the gift cannot be met because the engagement is dissolved or the marriage relationship is not concluded, the donated property, such as bride price, should be returned.
2. Can I get back the valuables my lover gave me during my love?
There is no clear law about whether valuables given by men and women during their love can be returned after breaking up. Unless it is a bride price, the law stipulates that we will break up without a marriage certificate, and this bride price needs to be refunded in full.
Bridal gifts are different from ordinary gifts. The bride price is a gift based on the feelings of both parties and aimed at concluding a marriage. It is a property behavior based on marital status. The Interpretation of the Supreme People's Court on Several Issues Concerning the Application of the Marriage Law of the People's Republic of China (II) clearly stipulates the issue of bride price disputes in the form of judicial interpretation, among which Article 10 stipulates:
The people's court shall support the request of the parties to return the bride price paid according to the custom if it is found that it belongs to the following circumstances:
1. Both parties failed to go through the marriage registration formalities;
2. Both parties have gone through the marriage registration formalities, but they have not lived together;
3. Paying before marriage and causing difficulties for the payer.
