Regulations on Autonomy of Rongshui Miao Autonomous County (amended by 1995)
Chapter I General Provisions Article 1 These Regulations are formulated in order to effectively protect the equal rights of all ethnic groups in Rongshui Miao Autonomous County, safeguard national unity, ensure the organs of self-government of the Autonomous County to exercise their autonomy and promote economic and social development. Article 2 These Regulations are formulated in accordance with the principles stipulated in the Constitution of People's Republic of China (PRC) and the Law of People's Republic of China (PRC) on Regional National Autonomy (hereinafter referred to as the Constitution and the Law of Autonomy) and in combination with the political, economic and cultural characteristics of all ethnic groups in Rongshui Miao Autonomous County. Article 3 Rongshui Miao Autonomous County (hereinafter referred to as Autonomous County) is a place where Miao people practice regional autonomy within the administrative region of Guangxi Zhuang Autonomous Region, and there are also ethnic groups such as Han, Zhuang, Dong, Yao, Mulao and Shui. Article 4 The organs of self-government of autonomous counties are autonomous county people's congresses and autonomous county people's governments.

The organs of self-government of Autonomous County are located in Rongshui Town. Article 5 The organs of self-government of autonomous counties shall, in accordance with the provisions of the Constitution, the autonomous law and other laws, exercise the functions and powers of state organs at the county level and exercise the right of self-government.

The organs of self-government of autonomous counties safeguard national unity and ensure the observance and implementation of the Constitution and laws in autonomous counties. Actively complete various tasks assigned by state organs at higher levels. Article 6 These Regulations are autonomous regulations for the implementation of the Constitution, autonomous laws and other laws in autonomous counties.

State organs, social organizations, enterprises, institutions and citizens within the administrative area of Autonomous County must abide by these regulations. Chapter II Organization and Work of Autonomous Organs Article 7 The people's congresses of autonomous counties are local organs of state power in autonomous counties. Its permanent body is the Standing Committee of the Autonomous County People's Congress. Article 8 Among the deputies to the people's congresses of autonomous counties, the population represented by each of the Miao and Han nationalities is equivalent to the population represented by each of the deputies to the people's congresses of autonomous counties. The population represented by each representative of Zhuang, Dong and Yao can be appropriately less than that represented by each representative of the Autonomous County People's Congress. Mulao and Shui people should also be represented. There should be a certain number and proportion of women representatives. Ninth Autonomous County People's Congress shall exercise its functions and powers in accordance with the Organic Law of People's Republic of China (PRC) Local People's Congresses and Local People's Governments at All Levels (hereinafter referred to as the Organic Law), and at the same time exercise the following functions and powers in accordance with the provisions of the Constitution and the Autonomous Law:

(a) according to the functions and powers entrusted by the Constitution and the autonomous law, and according to the actual situation of autonomous counties, formulate and amend autonomous regulations and separate regulations.

(II) Autonomous County in the process of implementing the laws and regulations of the state, when there are special issues that need to be revised or supplemented, it may, according to the authority given by laws and regulations and the actual situation of the Autonomous County, formulate provisions for revising or supplementing a certain issue, which shall be implemented after being reported to the Standing Committee of the People's Congress of the autonomous region for approval.

(3) There is no clear scope for flexibility in the implementation of national laws and regulations in autonomous counties, but in order to ensure the compliance and implementation of laws and regulations within their respective administrative areas, when it is necessary to make flexibility or supplementary provisions on a special issue, the people's congress may, in accordance with the principles stipulated in Article 4 of the Autonomous Law, implement it in accordance with the provisions of Item (2) of this Article. Article 10 The Standing Committee of the People's Congress of an Autonomous County shall have citizens of the ethnic group exercising regional autonomy as its director or deputy director, and other ethnic groups shall also have appropriate personnel.

Among the members of the Standing Committee of the Autonomous County People's Congress, the proportion of citizens of ethnic groups exercising regional autonomy is equivalent to or slightly higher than the proportion of their population in the total population of the county. Eleventh Autonomous County People's Congress Standing Committee is responsible for the Autonomous County People's Congress and report its work, and exercise its functions and powers in accordance with the provisions of the organization law. Article 12 The county magistrate of an autonomous county shall be a Miao citizen. In addition to the citizens of the ethnic groups exercising regional autonomy, there should also be citizens of other ethnic groups among the deputy heads of counties.

Among the other members of the Autonomous County People's Government, the proportion of ethnic minority citizens exercising regional autonomy shall be equal to or slightly higher than the proportion of their ethnic population in the total population of the county, and the Han nationality and other ethnic minorities shall have appropriate places. Thirteenth Autonomous County People's Government shall be responsible for and report on the work of the Autonomous County People's Congress and the Autonomous Region People's Government. When the Autonomous County People's Congress is not in session, it shall be responsible to the Standing Committee of the Autonomous County People's Congress and report its work. Fourteenth Autonomous County People's Government shall exercise its functions and powers in accordance with the provisions of the Organization Law, and at the same time exercise the following functions and powers in accordance with the principles stipulated in the Constitution and the Autonomous Law:

(a) according to the actual situation and needs of Autonomous County, under the principle of not violating the Constitution and other laws, formulate special policies and flexible measures to accelerate the economic, cultural and social development of Autonomous County.

(two) decisions, resolutions, orders and instructions of state organs at higher levels in the implementation, if there is not suitable for the actual situation of Autonomous County, you can make a flexible implementation or stop the implementation of the decision, reported to the state organs at higher levels for approval before implementation. Chapter III Organization and Work of Autonomous County People's Courts and People's Procuratorates Article 15 The organization and work of Autonomous County People's Courts and People's Procuratorates shall be conducted in accordance with the provisions of the law. Sixteenth autonomous county people's courts and people's procuratorates shall have Miao citizens as presidents, procurators or vice presidents and deputy procurators. Other members should be equipped with citizens of ethnic groups that practice regional autonomy. Seventeenth autonomous county people's courts and people's procuratorates independently exercise judicial power and procuratorial power according to law, and no administrative organ, social organization or individual may interfere.
