Disability appraisal by the Forensic Appraisal Center of Nanfang Hospital

Legal analysis: Disability appraisal refers to the appraisal of the degree of disability after injury. The scope of disability appraisal includes traffic accident disability, work accident disability, accidental injury disability, and fighting disability. Generally, the judicial department (such as the traffic police team, police station, court) will make the corresponding disability appraisal based on the relevant admission records provided by the hospital or entrust a disability appraisal agency. As long as it is an appraisal institution established in accordance with the law and has appraisal qualifications, the court will generally accept it.

Legal basis: "General Principles of Forensic Authentication Procedures"

Article 14 Forensic appraisal institutions shall review entrusted appraisal matters, appraisal materials, etc. If it falls within the scope of the agency's forensic appraisal business, the appraisal purpose is legal, and the appraisal materials provided can meet the needs of the appraisal, it shall be accepted. If the identification materials are incomplete or insufficient and cannot meet the needs of the identification, the judicial identification institution may require the client to supplement them; if the supplements can meet the needs of the identification, the application shall be accepted.

Article 28 The forensic identification institution shall complete the identification within thirty working days from the date when the judicial identification authorization letter takes effect. If the appraisal matters involve complex, difficult or special technical issues or the appraisal process takes a long time, the time limit for completing the appraisal can be extended with the approval of the person in charge of the institution. The extension time limit shall generally not exceed thirty working days. If the appraisal time limit is extended, the client shall be informed promptly. If the forensic appraisal agency and the client have other agreements on the appraisal time limit, the agreement shall prevail. The time required to supplement or re-extract identification materials during the identification process will not be included in the identification time limit.
