1 general rules
1. 1 formula basis
1. 1. 1 This standard is formulated in order to solve the specialized problems involved in the identification of personal injury and disability in the trial of cases by people's courts.
1. 1.2
This standard is based on the Criminal Law of People's Republic of China (PRC), the General Principles of the Civil Law of People's Republic of China (PRC) and other relevant laws, combined with the reality of the people's court hearing personal injury cases, and based on the theory of medicine and forensic medicine, scientifically classify the disability level.
1.2 Scope of application
This standard is applicable to the appraisal of the degree of personal injury and disability involved in the trial of criminal, civil and administrative cases by the people's courts, which belongs to the appraisal of the degree of disability caused by occupational diseases and road traffic accidents, and this standard is not applicable.
1.3 identification principle
The identification of 1.3. 1 should be carried out after the injury and complications are treated to the end of clinical treatment or the state is stable.
1.3.2 The appraisal shall be based on the consequences or outcomes of human injury and the relationship between disability and injury.
1.3.3 when the identification involves the original injury (disability), the relationship with the existing consequences or outcomes shall be explained.
1.3.4 if the identification of injuries in the same part involves multiple regulations or injuries in more than two parts, the disability level shall be identified separately and graded according to the highest level. If the two grades are the same, they will be promoted to one grade at most.
1.3.5 Identification involves injury types not listed in this standard, and shall be conducted according to the classification basis of disability grade and the most similar clauses in this standard.
1.4 appraisers and their rights and obligations
1.4. 1 appraiser refers to a professional with the qualification of a forensic expert and experience in forensic clinical practice.
1.4.2
The appraiser has the right to know the situation related to the injury, consult the files and medical records, and conduct physical examination and necessary auxiliary examination on the appraiser. The appraiser has the right to refuse the appraisal if the appraisal materials are incomplete or beyond the scope of the appraisal specialty.
1.4.3 The appraiser shall conduct the appraisal scientifically and fairly, and implement the system of the appraiser's appearance in court and withdrawal according to law.
1.5 Disability level
According to the damage and dysfunction of tissues and organs, the degree of loss of work, study, daily life and social communication ability, and the degree of dependence on medical care and nursing, the disability is divided into ten levels, the most serious being level 1 and the lightest being level 10.
Sub-rule 2

2.2 Secondary disability
2.2. 1 quadriplegia (muscle strength of more than two limbs is Grade 2).
2.2.2 Tripplegia (muscle strength level 2).
2.2.3 Paraplegia or hemiplegia (muscle strength 1).
2.2.4 Paraplegia (muscle strength grade 2) with urinary incontinence.
2.2.5 facial scar is more than 90%, which seriously affects the appearance and is accompanied by organ dysfunction.
2.2.6 Loss of both eyes.
2.2.7 Blindness level 5.
2.2.8 One eyeball is missing, and the other eye is grade 5 blind.
2.2.9 Complete defect of bilateral maxilla or mandible.
2.2. 10 Unilateral maxilla and contralateral mandible were completely defective.
2.2. 1 1 Unilateral pneumonectomy with thoracoplasty, dyspnea grade III.
2.2. 12 Severe lung function injury.

2.3.3 Paralysis of three limbs or quadriplegia (muscle strength above three limbs is Grade 3).

2.3.5 Complete sensory or mixed aphasia.
2.3.6 facial scar is more than 80%, which seriously affects the appearance and is accompanied by organ dysfunction.
2.3.7 Severe facial disfigurement.

2.3.9 Loss or blindness in one eye is Grade 5, and blindness in the other eye is Grade 3.

2.3.24 Skin injury leads to scar formation, reaching more than 80% of body surface area.
2.4 Physical disability
2.4. 1 Triplegia or quadriplegia (muscle strength of both limbs is level 3).
2.4.2 Paraplegia hemiplegia (muscle strength level 3).
2.4.3 Moderate non-paraplegic dyskinesia.
2.4.4 Severe traumatic epilepsy.
2.4.5 facial scar is more than 60%, which obviously affects the appearance and is accompanied by organ dysfunction.
2.4.6 Blindness level III.
2.4.7 One eyeball is missing or blind for Grade 5, and the other eye has poor vision for Grade 2 or visual field ≤24% (or radius ≤ 15).
2.4.8 binocular visual field ≤ 16% (or radius ≤ 10).
2.4.9 Binaural hearing loss ≥9 1dBHL.

2.5 level 5 disability

2.6 level 6 disability
2.6. 1 Moderate organic mental disorder, limited ability of daily living, need guidance.
2.6.2 quadriplegia (muscle strength grade 4).
2.6.3 Unilateral paralysis (muscle strength level 2).
2.6.4 Incomplete aphasia.
2.6.5 Moderate traumatic epilepsy.
2.6.6 cerebrospinal fluid leakage cannot be repaired.
2.6.7 Bilateral vestibular function is completely lost, and it is difficult to walk with eyes open and feet closed.
2.6.8 Facial scar is more than 20%, which obviously affects the appearance.
2.6.9 A large number of tiny spots or pigments on the face have obviously changed by more than 75%, which affects the appearance.
2.6. 10 Low vision in one eye is Grade 2, and low vision in the other eye is Grade 1.
2.6. 1 1 One eyeball is missing, and the ptosis of the other eye covers the pupil.
2.6. 12 binocular visual field ≤40% (or radius ≤ 25).
