Knowing that goods purchased overseas need to be taxed when brought into the country, Zhao still smuggled cosmetics, luxury goods and other goods purchased in Japan and South Korea into the country by way of luggage hiding and customs clearance logistics, and sold them for profit through Taobao, WeChat and other channels. Because there is no tax, the price of products sold by Zhao is much cheaper than that of regular channels.
At the beginning of this year, when a purchasing agent returned to China for machine inspection, Hangzhou Customs was attached to the airport customs and found that the image of Zhao's luggage was abnormal. Hangzhou Customs Anti-smuggling Bureau is affiliated to the Airport Customs Anti-smuggling Branch, and put on record the investigation of Zhao's smuggling of ordinary goods. Goods imported by trade generally need to pay value-added tax, consumption tax and customs duties, while overseas direct mail only needs to pay postal tax. According to the relevant provisions of China's Customs Law, articles for personal use with a total entry value of less than 5,000 RMB from overseas travel inspection channels shall be released duty-free; More than 5000 yuan is taxable. Profitable goods, regardless of their value, must be declared to the customs and paid taxes according to regulations, otherwise they will be suspected of smuggling.
The police officer handling the case of Hangzhou Airport Customs Anti-smuggling Branch told the reporter that according to the relevant judicial interpretation, if the taxable amount of smuggled ordinary goods and articles does not reach 654.38+10,000 yuan, it will be treated as general smuggling. Tax evasion exceeds 654.38+10,000 yuan, which is in line with Article 153 of the Criminal Law that "the amount of tax evasion for smuggled goods and articles is relatively large" and constitutes the crime of smuggling ordinary goods and articles.
In recent years, some of the purchasing smuggling cases seized by Hangzhou Airport Customs Anti-smuggling Branch are part-time jobs, and more are professional purchasing. They purchase in large quantities through duty-free shops, mainly air passengers, supplemented by mail, and then sell through WeChat Taobao. Most of the people involved are women, mostly born in 1980s and 1990s, and 20% of them are post-90s college students with little experience, weak legal awareness, or just graduated from university. What is even more exaggerated is that in order to prove to customers that products are purchased from overseas, these professional purchasing agents not only broadcast the procurement process live, but even some people broadcast the whole process live.
The trend of procurement specialization is becoming more and more obvious. Part of purchasing has formed a "one-stop" refined division of labor, such as overseas purchasing, "air passenger", warehousing and wholesale to domestic distributors. Among them, "air water passengers" charge corresponding service fees according to the weight of goods.
Remind the vast number of inbound and outbound passengers to understand and consciously abide by laws and regulations, and don't easily help tour guides or other passengers bring their belongings into and out of the country, otherwise they may face jail time.
