Sentencing standard of disfigurement crime
Legal analysis: disfigurement on human face is a serious injury, causing serious injury, and it is sentenced to fixed-term imprisonment of not less than three years but not more than ten years.

Legal basis:

Article 234 of the Criminal Law of People's Republic of China (PRC) shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance. Whoever commits the crime mentioned in the preceding paragraph and causes serious injuries shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; Whoever causes death or serious disability by particularly cruel means shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death. Where there are other provisions in this Law, such provisions shall prevail.

5.2 Face and Auricle of Appraisal Standard of Human Injury Degree

5.2. 1 serious injury level 1

A) disfigurement (serious).

5.2.2 Serious injury level 2

A) Strip scars on the face (more than 50% are located in the central area), the single length exceeds 10.0cm, or the cumulative length of more than two scars exceeds 15.0cm.

B) facial massive scar (more than 50% is located in the central area), with a single area greater than 6.0cm2, or the cumulative area of more than two pieces is greater than 10.0cm2.

C) Small patches of scar or obvious abnormal pigment on the face, with the cumulative area reaching 30% of the face.

D) atrophy or loss of one eyeball.

E) Eyelid loss is equivalent to more than one upper eyelid 1/2.

F) Severe eversion of single eyelid or moderate eversion of double eyelids.

G) One side of ptosis completely covers the pupil.

H) enophthalmos caused by orbital fracture on one side is more than 0.5cm.

I) A nasolacrimal duct and medial canthus ligament are broken.

J) More than 30% of the nose is broken or defective.

K) The cumulative amount of amputation, defect or contracture of auricle is equivalent to more than 50% of the area of an auricle.

L) Lip separation or defect, exposing more than 3 teeth.

M) The tongue body is broken or defective to the lingual frenum.

N) Tooth loss or tooth fracture is more than ***7.

O) Difficulty in opening mouth caused by third degree injury.

P) Facial nerve injury leads to paralysis of most unilateral facial muscles, resulting in incomplete eyelid closure and crooked mouth.

Q) disfigurement (slight).
