How to compensate for sudden illness and death while working in Shanghai, and how much can you compensate?
According to Article 15 of the Regulations of Shanghai Municipality on Industrial Injury Insurance, "An employee shall be regarded as an industrial injury if he/she has one of the following circumstances: (1) He/she died of sudden illness or died within 48 hours after being rescued", which shall be regarded as an industrial injury. For the specific treatment of work-related injuries, see Article 41: "If an employee dies at work, his immediate family members shall receive funeral subsidies, dependent relatives' pensions and one-time work-related death subsidies from the work-related injury insurance fund in accordance with the following provisions: (1) The funeral subsidies shall be the average monthly salary of employees in the city in the previous year for six months when the employee dies at work; (2) The pension for supporting relatives shall be paid to the relatives who provided the main source of livelihood and were unable to work during their lifetime according to a certain proportion of their wages one month before the death of an employee due to work. Among them, the spouse is 40% per month and other relatives are 30% per month; Lonely old people or orphans will increase by 10% every month on the basis of the above standards. The approved total pension for dependent relatives shall not be higher than the payment salary of the employee one month before his death due to work; (three) the standard of one-time work-related death subsidy is the average monthly salary of employees in the city in the previous year, which is 50 months after their work-related death.
