1. The patentee shall pay a certain fee every year from the year when the patent is granted to the end of the patent protection period.

(1) The applicant shall pay the patent registration fee, announcement printing fee, stamp duty and the annual fee for the year when the patent right is granted. Where an application for a patent for invention needs to pay the application maintenance fee, the applicant shall pay the application maintenance fee for each year together. Failure to pay or pay the full fee at the expiration of the period shall be deemed as failure to go through the registration formalities. The annual fee for the year when the patent right is granted shall be paid within the time limit specified in the notice of granting the patent right issued by the Patent Office, and the annual fee thereafter shall be paid in advance within one month before the expiration of the previous year.

(2) Need to pay the application maintenance fee. Where an application for a patent for invention has not been granted a patent right for two years from the date of filing, the applicant shall pay the application maintenance fee from the third year. Anyone who becomes a patentee must pay the patent fee every year to protect his patent, which is the obligation of the patentee.

Second, the patentee has to pay a certain fee every year from the year when the patent is granted to the expiration of the patent protection period, and paying the annual patent fee correctly is the premise of maintaining the validity of the patent right!

After the patent application is authorized, the patent applicant shall pay the annual fee of the year when the patent right is granted in addition to the patent registration fee when going through the registration formalities. The annual fee for subsequent years shall be paid in advance within one month before the expiration of the previous year.

If it is not paid within the specified time or the amount paid is insufficient, it can be paid within 6 months from the date of the expiration of the annual fee, and the corresponding amount of late payment fee will be paid at the same time, otherwise the patent right will be lost! The specific calculation method for paying late fees is as follows:

(1) If the term exceeds 1 day to 1 month (including 1 whole month), only the annual fee needs to be paid, and there is no need to pay the late fee;

(2) If it exceeds 1 month to 2 months (including 2 whole months), the amount of overdue fine payable shall be 5% of the annual fee;

(3) If the overdue payment is more than 2 months to 3 months (including 3 whole months), the amount of overdue payment shall be10% of the annual fee;

(4) If the overdue payment is more than 3 months to 4 months (including 4 whole months), the amount of overdue payment shall be 65438+ 05% of the annual fee;

(5) If the overdue period is more than 4 months to 5 months (including 5 whole months), the amount of overdue payment shall be 20% of the annual expenses;

(6) If the overdue period is more than 5 months to 6 months (including 6 whole months), the amount of overdue payment shall be 25% of the annual expenses.
