1, WeChat business also needs a business license. According to Article 7 of the Measures for the Administration of Online Transactions promulgated by the State Administration for Industry and Commerce:
Operators engaged in online commodity trading shall handle industrial and commercial registration according to law, and submit their real identity information such as name, address, valid identity certificate and effective contact information to the third-party trading platform. At present, a considerable number of WeChat merchants have not registered for industry and commerce, nor have they submitted corresponding identity information to third-party trading platforms, and they have directly opened stores for sale in the form of "zero threshold" and "zero audit", which is suspected of administrative violations.
2. Some overseas goods purchased by WeChat business have been suspected of smuggling. According to Article 47 of the Customs Law:
Those who enter the country by shopping from abroad shall truthfully declare the types, prices, uses and other information of the goods. Imported goods for "self-use" can be duty-free or subject to lower tariffs, while "resale" can be subject to higher trade tariffs, but not duty-free. At present, most of the profits of overseas purchasing in WeChat business come from unpaid trade tariffs, which enter the country duty-free for the purpose of "self-use" and then change from "self-use" to "resale" for profit. According to the second item of Article 154 of the Criminal Law: "Whoever sells goods and articles imported with specific duty reduction or exemption in China for profit without the permission of the customs" constitutes the crime of smuggling ordinary goods and articles, and shall be given administrative punishment or criminal punishment respectively according to the seriousness and amount.
3. Some behaviors of WeChat merchants selling goods through "distribution" and "consignment" are suspected of illegal pyramid schemes.
The normal and legal sales model is that merchants purchase goods from manufacturers or the last home and then sell them to the next home. The difference between the purchase price and the selling price determines its profit, and the sales behavior after buying a house has nothing to do with the profit of the merchant. The essence of MLM lies in "multi-level related operation", that is, the profit of a merchant is not only related to the purchase price and selling price, but also depends on the "sales" behavior after purchase. At present, there are many modes of "distribution" and "consignment" in WeChat business circle, which implement "cross-level commission", recruit agents in the name of consignment products, form a hierarchy according to a certain order, and directly or indirectly take the number of development people and offline sales as the basis for reward rebate. According to Article 7 of the MLM Prohibition Ordinance promulgated by the State Council and Article 224-1 of the Criminal Law, this sales model belongs to pyramid selling, which may be subject to administrative or criminal punishment depending on the level, number of people and the amount involved.
