Chapter I General Principles

Article 2 The people's police of public security organs shall strictly abide by the provisions of the People's Police Law of the People's Republic of China, the Civil Service Law of People's Republic of China (PRC) and other laws and regulations on the discipline of the people's police of public security organs. Article 26. Chapter I General Principles
Article 1 This Law is formulated in accordance with the Constitution in order to safeguard national security and social order, protect the legitimate rights and interests of citizens, strengthen the construction of the people's police force, strictly administer the police, improve the quality of the people's police, ensure that the people's police exercise their functions and powers according to law, and ensure the smooth progress of reform, opening up and socialist modernization.

Chapter II Duties and Powers
Article 6 The people's police of public security organs shall perform the following duties according to the division of responsibilities:

(3) Maintaining traffic safety and traffic order and handling traffic accidents;

Article 7 The people's police of public security organs may, according to law, impose administrative compulsory measures and administrative penalties on individuals or organizations that violate public security administration or other laws and regulations on public security administration.
Article 8 People's police of public security organs may forcibly take away, detain or take other measures prescribed by law against persons who seriously endanger public order or threaten public safety.
Article 9 In order to maintain public order, the people's police of the public security organ may interrogate and inspect the persons suspected of violating the law and committing crimes on the spot upon showing the corresponding certificates; After cross-examination and inspection, in any of the following circumstances, with the approval of the public security organ, it may be taken to the public security organ for further cross-examination:

The detention time shall not exceed 24 hours from the time when the interrogated person is taken to the public security organ. Under special circumstances, with the approval of the public security organ at or above the county level, it may be extended to 48 hours, and the interrogation record shall be kept. If the cross-examination is approved to continue, it shall immediately notify the family members or the unit to which it belongs. If the interrogation is not approved, the interrogated person shall be released immediately. Article 10 When the people's police of public security organs resist arrest, riot, escape from prison, snatch guns or other violent acts, they may use weapons in accordance with relevant state regulations.
Eleventh in order to stop serious illegal and criminal activities, the people's police of public security organs can use police equipment in accordance with the relevant provisions of the state.

Article 14 The people's police of public security organs may take protective and restrictive measures against mental patients who seriously endanger public security or the personal safety of others. Article 15 The public security organs of the people's governments at or above the county level may, in order to prevent and stop acts that seriously endanger public order, restrict people and vehicles from passing or staying in a certain area and time, and may implement traffic control when necessary. The people's police of public security organs may take corresponding traffic control measures in accordance with the provisions of the preceding paragraph.
Article 16 The public security organ may take technical reconnaissance measures according to the relevant provisions of the state and through strict examination and approval procedures.
Seventeenth public security organs of the people's governments at or above the county level may, with the approval of the public security organs at higher levels and the people's governments at the same level, implement on-site control over emergencies that seriously endanger public order. The people's police of the public security organ may, in accordance with the provisions of the preceding paragraph, take necessary measures to forcibly disperse, and forcibly take those who refuse to obey away from the scene or immediately detain them.
Article 18 The people's police of state security organs, prisons and reeducation-through-labor administrative organs, and the judicial police of people's courts and people's procuratorates shall exercise their functions and powers respectively in accordance with the provisions of relevant laws and administrative regulations.
Article 19 The people's police shall perform their duties in case of emergency within the scope of their duties during non-working hours.
Chapter III Obligations and Discipline
Twentieth people's police must do:
(a) Fair law enforcement and fair conduct;

(3) Treat people politely and perform their duties in a civilized manner;
(4) Respect people's customs and habits.

Chapter IV Organization and Management

Article 26 The people's police shall meet the following conditions:
(1) Citizens who have reached the age of 18;

(5) Having graduated from high school or above;
(6) Volunteering in the work of the people's police.
One of the following circumstances, shall not serve as the people's police:

Article 35 Whoever refuses or obstructs the people's police from performing their duties according to law and commits any of the following acts shall be given administrative penalties for public security:
(a) openly insulting the people's police who are performing their duties;

(3) refusing or obstructing the people's police from entering the relevant residence or place in pursuit, search, rescue and other tasks;

Article 44 When performing their duties, the people's police must consciously accept the supervision of society and citizens. Provisions directly related to public interests formulated by the people's police organs shall be made public.
Forty-fifth people's police in the process of handling public security cases, under any of the following circumstances, should withdraw, and the parties or their legal representatives also have the right to ask them to withdraw:
(1) Being a party to the case or a close relative of the party;
(2) He or his close relatives have an interest in the case;
(3) Having other relations with the parties to the case, which may affect the fair handling of the case. The withdrawal specified in the preceding paragraph shall be decided by the relevant public security organ. The withdrawal of the people's police from handling criminal cases shall be governed by the provisions of the Criminal Procedure Law.
Forty-sixth citizens or organizations have the right to report and accuse the people's police of violations of law and discipline in the people's police organs, people's procuratorates and administrative supervision organs. The organ that accepts the report and complaint shall promptly investigate and deal with it, and inform the prosecutor and complainant of the investigation results. No one may suppress or retaliate against citizens or organizations who report or accuse according to law.
Article 47 The public security organ shall establish an inspection system to inspect the implementation of laws, regulations and disciplines by the people's police of the public security organ.
Chapter VII Legal Liability
Article 48 People's policemen who commit any of the acts listed in Article 22 of this Law shall be given administrative sanctions. If a crime is constituted, criminal responsibility shall be investigated according to law. Administrative sanctions are divided into: warning, demerit recording, demerit recording, demotion, dismissal and dismissal. The people's police who are subject to administrative sanctions may lower their police ranks or cancel their police ranks in accordance with relevant state regulations. When necessary, the people's police who violate discipline can be taken to stop performing their duties and be confined.
Forty-ninth people's police in violation of the provisions of the use of weapons, police equipment, which constitutes a crime, shall be investigated for criminal responsibility according to law; If it does not constitute a crime, it shall be given administrative sanctions according to law.
Fiftieth people's police who infringe upon the legitimate rights and interests of citizens or organizations in performing their duties shall make compensation in accordance with the provisions of the State Compensation Law of People's Republic of China (PRC) and other relevant laws and regulations.
Chapter VIII Supplementary Provisions
Article 51 The Chinese People's Armed Police Force performs the security tasks entrusted by the state.
